Szanowny Panie Prezesie,

Medel z wielką uwagą i troską obserwuje rozwój sytuacji związany z polskim wymiarem sprawiedliwości  Z tego też powodu przedstawiciele MEDEL w osobach vice przewodniczącego Thomasa Guddata i oraz Anny Adamskiej – Gallant będą uczestniczyć w obradach Nadzwyczajnego Kongresu Sędziów Polskich, który odbędzie się w dniu 3 września 2016 r. w Warszawie, organizowanego przez Krajową Radę Sądownictwa i stowarzyszenia sędziowskie. W załączeniu przesyłam list MEDEL z dnia 12 sierpnia 2016 r. skierowany do Prezydenta Rzeczpospolitej Polskiej.

The Extraordinary Congress of the Polish Judges

the Extraordinary Congress

of the Polish Judges

on September 3rd 2016

in Warsaw.

 

 

Responsive justice and independent from the powers both the Executive and Legislative courts and judges are the cornerstone of the protection of fundamental rights and freedoms of citizens, the basis of the rule of law, as well as a guarantee of economic stability of Poland.

To step forward to, the reported among judges, widespread demands for the debate on the condition of the judiciary, threats to the independence of judges and the independence of the courts - Polish Judges Association “Iustitia”, Association of Judges “Themis”,  Association of Family Judges in Poland and the Association of Family Judges “Pro Familia”, along with the National Council of the Judiciary decided to convene the Extraordinary Congress of the Polish Judges on September 3rd 2016. (Saturday).

We are very pleased with the huge interest in the extraordinary Congress of Polish Judges. The number of the Declaration of attendee, which we have received, indicate that the initiative for the convening of the Congress was a good idea. We want to provide the opportunity to participate for the most judges and for this reason we have decided to change the room for bigger.

The Congress will be held in the Stefan Starzyński Hall on IV floor of The Palace of Culture and Science, and not in the Concert Hall on the 6TH floor. This change will allow a larger circle (approx. 600 persons) to join the venue, and at the same time will allow it last longer. We hope that this in a more comfortable and be able to discuss all proposed topics. If the number of applications exceeds the capacity of the Hall, the new reserve list is to be created, and the people on this list will be informed. 

The main topics of the Congress are:

-the way the appointment of judges and evaluation of refusing appointment by the President of the Republic of Poland candidates for the posts of judges;

-supervision of the Minister of Justice on the courts in the perspective of the provisions of the new law-the law on the public prosecutor's Office;

-the independence of the courts and the independence of the judges in the perspective of the planned changes in the regulations relating to the Common Courts system, Administrative Courts and Supreme Court;

-assessment of the situation related to the activities of the legislature and the Executive to the Constitutional Court, including the consequences of publish court`s verdicts;

-new draft of the law on the National Council of the Judiciary.

10.00-11.30 am – the speeches of guests inter alia

- Nuria Díaz Abad – the President of the European Network of the Councils of Judiciary (ENCJ),

- Judge András Baka – former President of Supreme Court in Hungary, former Judge of the European Court of Human Rights,

- Judge Nils Engstad - Chairman of the Consulting Council of the European Judges (CCJE)

- Judge Thomas Guddat - President of the German-Polish Association of Judges and the Vice President of MEDEL,

- Prof. Ryszard Piotrowski - (Warsaw University),

- Prof. Marek Safjan - judge of the Court of Justice of the European Union in Luxembourg,

- Prof. Andrzej Zoll - former President of the Constitutional Court in Poland,

11.30 - 12.15- discussion of the participants of the Congress with the participation of guest speakers

12.15 - 13.00 - coffee break

13.00 - 15.30 - discussion

15.30 - 16.15 - coffee break

16.15 - 17.00 - discussion of resolutions

17.00 - 17.30 - the summary and closing the Congress.

NADZWYCZAJNEGO KONGRESU SĘDZIÓW POLSKICH

 z 3 września 2016 roku

Sędziowie uczestniczący w Nadzwyczajnym Kongresie Sędziów zwracają uwagę opinii publicznej na istotną dla każdego obywatela rolę władzy sądowniczej jako gwaranta wynikającego z Konstytucji RP prawa do sądu i przestrzegania praw i wolności obywatelskich.

Władza sądownicza jest równorzędna wobec władzy ustawodawczej i wykonawczej. Wzajemne oddziaływanie (równoważenie) władz stanowi podstawę ustroju Rzeczypospolitej Polskiej (art. 10 Konstytucji RP).
